LEVEL CAPS: Why don't Pokémon max out at Level 40?
Last night I was pushing up some gyms in my hood at 3:30 in the morning (gotta find things to do when 40, lol), when my gym partner says "Yo, there's a Snorlax, wanna go for it?" So I say where and he tells me it's on the other side of town. I think to myself it's late and cold, so no. Then he says "wait, a spoofer just caught it, said it's a perfect lick x hyper beam" Now I'm thinking, f*ck this gym, we out!
I remember running my ass off for one back in January to only miss it by like 45 seconds, and a bunch of weirdos smiling cause they caught it. Worst feeling ever.
Maxed out at 39 he'll be 3307, but at 40 he'll be 3350. Why don't Pokémon max out at 40 like us?

If it wasn't on the nearby its not really Legit.
And based on this story "other side of town" makes it sound not legit.
And further based on this story, even then its still tainted because you profitted directly from a spoofer saying it was perfect and telling you moves.

Bro you could say what you want, information was passed to me while I was playing the game -- legit or not. Motivation comes in many forms, period. Nobody caught it for me, nobody spoofed it to my account, I made a decision and ran down on it. That's it. I'm good w that.
Maps exists. Chats exists. People talk. People text. 9 times out of 10, spoofers know before us all. I'm not in these streets to lose, and as long as I'm not playing with spoofers, I'm not trippin'.
It doesn't matter what you say on here. As a fellow NYC player that get many great catches you will find that some users on this site will hate on you for the simple fact that you caught something they didn't.
They will say you cheated, you pokemon is not legit, you should play honestly, and you should just walk around randomly and bump into pokemon.
Congrats on the good catch. Maybe one day ill run into you in a gym if you have defenders in NYC lol.
It is possible that they cap Pokémon at level 39 because:
If the server lags, the CPM still goes up to level 40, it is very unlikely that the lag causes the Pokémon go up to level 40.5 or above.
If they make it cap at level 40, the lag may cause the Pokémon go up to level 41 or above, since the power up data only goes up to level 41, the game may crash and your Pokémon will be at level 41.5 with only 10 CP left.
My guess is that they may raise the cap when more players reach lv38; I would also guess that they left it at player level 38 (for now) because of the total xp required?
In other words, my guess is that they have it at player level 38 for now because the majority of players aren't even close to that, but when more players get higher (a year from now or so?) they may raise it. Just a guess
