Max pokemons' level - post Gen2 release?

I 'd like to ask whether max the max level for pokemon is 40 or the bug keeps it at 39?

As one of my teammate reached level 38 today and he reported that he could only power up his pokemons once time, i.e level 39. I thought the cap level for pokemons is 40...
