Ex passes ho-oh?

I've read people guessing new ex passes could be ho-oh, wouldn't it have been data mined or whatever showing he's in the game and his moves etc that hasn't happened correct??

Ho-oh's data is already in the game, that's how we know it's current moveset and base stats.

It doesn't matter if it's not obtainable right now - Thunder Shock on Zapdos became a legacy move before it was released, and Mewtwo got a 9% reduction in all stats before its release.

So basically your saying there is not anything else needed for oh-oh actually be obtained in the game any moment? Or would something else have to happen like a final straw so to speak?
